Biography
Ilenna has significant and diverse experience in conducting large scale commercial dispute resolution, litigation and arbitration, with an emphasis on contract disputes, particularly within the resources industry and in relation to the Trade Practices Act and Corporations Act, government/public sector/administrative law and native title.
Ilenna is a member of the firm’s international arbitration group.
Ilenna has conducted proceedings on behalf of overseas and Australian clients, publicly listed companies, private companies and individuals on matters including:
- commercial contractual disputes regarding joint ventures, long term supply contracts, termination of distribution arrangements, disputes between principals and contractors, long-term multi-party collusive tendering arrangements, breaches of the Trade Practices Act, takeovers of public companies, director’s duties and copyright infringement;
- challenges to decisions of Regulators, applications for judicial review and "test case" proceedings brought by ASIC relating to the financial services provisions of the Corporations Act.
Ilenna has also advised owners of significant and unique infrastructure in dealings with government bodies within multi-layered Federal and State statutory frameworks.
In advising on dispute resolution matters, Ilenna focuses on clients’ short and long term commercial objectives and develops effective strategies accordingly.
Ilenna has conducted successful appellate work in the High Court of Australia and has conducted proceedings in the Federal Court of Australia and the Supreme Courts of Queensland, New South Wales, Victoria and the Northern Territory.
Given her extensive experience in conducting litigation and arbitrations, Ilenna has presented to industry bodies and given internal presentations on topics including the new cartel provisions of the Trade Practices Act, pre-contractual representations - misrepresentation, estoppel and mistake, decision making requirements under the judicial review legislation and the preparation of affidavits/witness statements, engagement of experts and briefing counsel.
She is actively engaged in several charities and Minter Ellison’s community investment programme.
Ilenna is also Solicitor of the Supreme Court of Queensland, Solicitor of the High Court of Australia and was an Associate to the Honourable Mr Justice Derrington, Supreme Court of Queensland (1997-1998).
