Dispute Resolution

Minter Ellison has an outstanding track record in the strategic resolution of disputes throughout Greater China and the Asia-Pacific region. We offer specialist expertise in complex commercial litigation and alternative forms of dispute resolution process, including domestic courts, arbitration and mediation.  We also advise companies on regulatory and compliance matters, including competition law, data privacy, fraud and money laundering.

Working with our colleagues in employment, energy, environment and regulatory fields, we integrate our industry expertise and litigation skills to deliver comprehensive service to our clients.

Our dispute resolution lawyers frequently involved act for multinational corporations involved in joint venture arrangements with domestic partners or regional disputes, which require consideration of Cross-border conflict of laws and jurisdictional issues as well as knowledge and an understanding of the domestic court process.

Through past matters the team has developed close working relationships with the leading disputes lawyers in the major Asian jurisdictions and centres, working as required to supervise and case manage the domestic aspects of disputes.

Major Projects

We have a wealth of experience, advising public and private sector sponsors, project financiers, developers, bidders, concession holders and contractors on major projects, privatisations, corporatisations and acquisitions across the Asia Pacific region.

We are at the cutting edge of PPP development, acting for the successful bidders on Hong Kong's first two PPP projects: the International Exhibition Centre and the SkyCity Hotel.

We also have one of the largest and most experienced resources and energy teams in the Asia Pacific (100+ lawyers).  Our lawyers have advised on groundbreaking LNG procurement deals, including our work for the past six years advising LNG sellers to the Guangdong LNG Project, China's first LNG import project and advising LNG buyers and LNG terminal developers in South Korea, Singapore, China and Japan. This has provided us with a comprehensive understanding of the operational and commercial aspects of the LNG supply chain which enables us to provide strategic advice to our clients on all aspects of LNG projects. 

We also advise in other areas of the energy sector including power, developers, financiers, contractors and off-takers throughout Asia and in particular in India, China and Thailand.

Construction

Minter Ellison has one of the strongest construction, engineering and infrastructure teams in the Asia Pacific region with a high profile in Greater China and our track record of significant work in the region is widely recognised. 

Our Construction group advises owners, contractors, subcontractors, consultants and governments on all aspects of major engineering and construction projects. This includes:

  • drafting of contracts
  • tendering and negotiation

Real Estate, Planning & Environment

Real Estate and Planning

We offer a comprehensive range of property-related legal services for developers, investors, owners, landlords and property funds managers.

We provide commercially relevant, strategic advice on structuring, acquisition, finance, development, disposal and leasing for high value, complex property transactions.  We have particular experience in development, planning and land use matters and property joint venture structuring.  We also advise on the legal aspects of property valuation, rent and rating disputes.

Environment

We advise on regulatory and administrative requirements for environmental, health and safety matters such as planning consents, permits and pollution licenses, and performance and liability standards, throughout the Asia Pacific region. We assist clients in the preparation of environmental impact assessment reports, crafting environmental management systems and policies, participate in environmental audits and undertake investigations where potential violations are suspected. We have a long-standing commitment to helping companies respond to the risks and opportunities of environmental law and regulation.
